A.P. Green Industries Asbestos Trust

A.P. Green (APG) Industries was a popular manufacturer of refractory products during World War I and II. APG used a dangerous mineral known as asbestos in its products until about 1973 despite known dangers. Anyone who was exposed to APG’s asbestos products is at risk of developing related diseases, including mesothelioma. The APG Asbestos Trust was established to compensate victims.

What Is Asbestos? What Are Its Associated Health Risks?

Asbestos is a group of minerals that were used as a popular ingredient or additive for manufacturing purposes due to its availability, low cost, and natural ability to resist heat and corrosion. Asbestos was included in a variety of consumer products through most of the 1900s until it was identified as a “hazardous air pollutant” and regulated by the Environmental Protection Agency in 1970.

Despite being aware of known health risks, many manufacturers continued to use asbestos until around the 1990s. Anyone who is exposed to asbestos could be at risk of inhaling or ingesting microscopic particles that can become permanently lodged inside the body. Once there, the asbestos fibers can cause enough irritation and inflammation to result in serious health consequences. This includes an aggressive form of cancer known as mesothelioma.

Asbestos Products Manufactured by A.P. Green Industries

A.P. Green Industries was established in 1910 as a manufacturer of refractory products. A refractory is a material that is resistant to heat, pressure and chemicals. Asbestos was a popular product for use in this industry due to its resistance to all three. APG added asbestos to refractory products that needed to withstand high heat or chemical corrosion.

Asbestos products that were made and distributed by APG include:

  • Castable block mix
  • Dropsy fry
  • Green PC
  • Greencast
  • Insblock
  • Insulating cement
  • Insulation adhesive
  • Insulation coating
  • Kast-O-Lite gunning refractory
  • LoAbrade gunning refractory
  • Loose wool insulation
  • Mizzou gunning refractory
  • Refractory bricks (firebricks)
  • SK-7 cement
  • Steelplant castable
  • Therm-O-Flake block insulation
  • Therm-O-Flake coating

Most of these products were manufactured between the 1940s and early 1970s. Anyone who was involved in the production, installation, maintenance or repair of these products may have been exposed to asbestos. This includes older asbestos materials from APG that have decomposed, as they may release asbestos dust into the air if disturbed.

Who Might Have Been Exposed to A.P. Green Industries’ Asbestos Products?

According to the National Cancer Institute, being exposed to asbestos even once can result in adverse health effects. However, the individuals who are most at risk of developing mesothelioma, asbestosis and other asbestos-related illnesses are those who are exposed to asbestos on a regular basis, such as people who work in high-risk occupations.

Anyone who worked for A.P. Green Industries at one of its product manufacturing plants may have suffered harmful asbestos exposure. These individuals regularly worked in an environment polluted with asbestos fibers, putting them at risk of developing related diseases. In addition, any person who worked with or around asbestos products created by APG could be at risk. This includes construction workers, steel workers, shipyard workers and military members.

APG has published a list of 1,865 occupations with known exposure to its asbestos-containing products, as well as 9,012 designated sites across the United States where A.P. Green Industries products were made, installed or used. These sites include chemical plants, manufacturing companies, metalworks, oil companies, refineries, corporations, and schools and universities. Although APG discontinued the use of asbestos in its products in 1976, this was too late for thousands of victims who had already been exposed.

About the APG Asbestos Trust

As a result of using asbestos in its products, A.P. Green Industries faced hundreds of thousands of lawsuits from victims and their families. By 2002, the financial pressure from asbestos litigation led to APG filing for Chapter 11 bankruptcy. As is the case with many companies and corporations that went bankrupt due to mesothelioma lawsuits, APG created an asbestos trust fund as part of its bankruptcy restructuring plan.

An asbestos trust fund is a source of financial compensation that can be made available to victims of asbestos exposure without requiring them to file lawsuits. Accessing the funds in an asbestos trust fund requires proof that a claimant has been diagnosed with mesothelioma or another asbestos-related illness and was exposed to an asbestos-containing product created by the company that established the trust.

Two different trusts receive asbestos claims related to A.P. Green Industries’ products: U.S. Gypsum Asbestos Personal Injury Settlement Trust and APG Asbestos Trust. APG was acquired by U.S. Gypsum in 1967. These trust funds pay 12.7 and 4.5 percent, respectively, of assigned claim settlement values. Payment percentages allow asbestos trusts to continue paying victims in the future.

How to File a Claim With the APG Asbestos Trust

Anyone who was exposed to APG’s asbestos refractory products and has developed a related disease may be eligible for a portion of the funds available in one of the trusts. If you believe you are a qualified claimant, start the filing process by contacting a mesothelioma attorney for advice and assistance.

An attorney can guide you through the steps it takes to file a trust fund claim, including:

  • Choosing your type of claim: selecting the correct asbestos trust fund and the right review process (Expedited vs. Individual Review) for your unique case and goals.
  • Filing the Claim Form: downloading, completing and submitting the required Claim Form based on the trust you are using and the review process you desire.
  • Submitting supporting documentation: collecting and filing evidence that supports your claim, such as medical records (or a death certificate) and asbestos exposure information.

An experienced asbestos attorney can make it easier to pursue the financial compensation that you need to pay for necessary health care costs, mesothelioma treatments, end-of-life or palliative care, lost wages, and more. An attorney can take care of the legal process for you while you focus on your future.
